New Jesey Man Sues After Claiming He Found Extra Topping Inside His Delivery Sandwich

According to a report from the New York Post, a New Jersey man claims he found a pair of dentures inside a Jersey Mike’s cheesesteak delivered through Grubhub. The bizarre discovery has since sparked a lawsuit against the delivery driver, Grubhub, and Jersey Mike’s.

Fernando Rodriguez alleges he ordered the sandwich through Grubhub in April 2025. According to the lawsuit, the bag appeared sealed with tape, but he allegedly discovered dentures inside the cheesesteak after opening the order.

The allegations stem from a police investigation and a civil lawsuit reported by the New York Post. The claims have not been proven in court, and Jersey Mike’s has not been found liable.

Police Say The Grubhub Driver Allegedly Admitted What Happened

According to a police report cited by the New York Post, officers contacted Grubhub delivery driver Theresa Gildea after Rodriguez returned to the Jersey Mike’s restaurant with the sandwich and dentures. Police say Gildea initially claimed the dentures belonged to her father before later admitting she was eating her own lunch while checking Rodriguez’s order because of previous complaints about incorrect deliveries.

Investigators say Gildea allegedly told officers she accidentally placed the dentures inside the customer’s sandwich.

The Jersey Mike’s And Grubhub Lawsuit Explained

In the alleged lawsuit, Rodriguez supposedly accuses Gildea of tampering with the food. The complaint also alleges Grubhub was negligent in hiring and supervising the driver while claiming Jersey Mike’s failed to properly package and secure the delivery order.

Grubhub said Gildea is no longer contracted to deliver through its platform. Jersey Mike’s did not publicly respond to the allegations when the lawsuit was first reported by the New York Post.

A Food Delivery Mistake Unlike Any Other

Wrong orders, missing fries, and forgotten drinks happen every day. Allegedly receiving someone else’s dentures inside a Jersey Mike’s cheesesteak is another story entirely.

In the lawsuit, Rodriguez claims he suffered nausea, emotional distress, and concerns about food contamination. The allegations remain unproven while the case moves through the courts.
