A newlywed bride’s honeymoon was ruined, and her cancer treatment was delayed due to an alleged false DUI arrest by the Phoenix police. Now, she is seeking compensation for the harm caused by the ‘fabricated’ case through a lawsuit against the police and the city of Phoenix.
While police officers are sworn to protect and serve the people, rogue officers sometimes abuse that authority, dragging innocent people into legal battles they never should have faced.
Brianna Longoria from Fresno, California, was arrested for DUI on December 29, 2024, a day after her wedding, despite registering a 0.00 on the breath test.
The federal lawsuit claims that she even tested negative for drugs and alcohol, raising questions about why she was arrested at all.
Phoenix Police Arrest Longoria Despite Negative Breath Test

According to a report by the New York Post, Longoria was out on a late-night drive in a rental car with her new husband when the police pulled her over. The officers initially claimed that she ran a red light and pointed out problems with the vehicle’s rear lights. However, the investigation took a turn when they tested her for DUI.
One officer was heard on the bodycam saying he was not expecting a positive reading in the breath test. Despite the device displaying three zeros, Longoria was arrested on suspicion of DUI. Police justified the arrest by saying that she had red eyes. The officer told her, “I do believe that you’re impaired.”
One of the officers was heard saying, “They’re going to kick me off the squad if I don’t get a DUI,” after Longoria was taken into custody. His fears came true.
Eventually, prosecutors dismissed the DUI charges against Longoria in April 2025 after the police failed to present sufficient evidence to prove that she was impaired. The judge also canceled the suspension of her license, allowing her to get behind the wheel again after months of trauma and distress.
The lawsuit filed against the police alleged a blatant disregard for the DUI rules. It read:
“This case arises from Phoenix Police Department officers’ disregard of established constitutional rules governing DUI stops and arrests.”
It further alleges that the officers falsely arrested Longoria to “further their careers and follow the City’s inappropriate policy, practice, or custom of manufacturing DUI arrests.”
Longoria Seeks Justice and Changes in Policy
Despite the charges being dismissed, Longoria suffered immensely due to the false DUI arrest and is now seeking compensation for the losses she endured and the crucial moments she missed out on with her husband, not to mention the arrest that now remains on her record through no fault of her own.
The false DUI arrest caused Longoria to miss part of her honeymoon, negatively affected her nursing studies, and caused delays in her cancer treatment, according to her lawyers.
The lawsuit was filed in December 2025 against the city of Phoenix and the officers involved that night. Longoria is now seeking damages, the removal of the arrest from her records, and policy changes.
The lawsuit claims that the case against Longoria was built on falsified observations and manufactured evidence. It stated:
“If there is a word to describe this case, it is ‘fabricated. Defendants stopped Brianna as she was driving based upon a fabricated traffic infraction, field tested her based upon fabricated observations, and then jailed and prosecuted her based upon even more fabricated evidence.”
