Florida Dad Passed Out at Gas Pump With 5-Year-Old in Car, Two Guns, and a BAC Twice the Legal Limit

What started as a “person-down” call at a Shell gas station in Plant City, Florida, quickly unfolded into one of those stories that makes you put your phone down for a second. Hillsborough County Sheriff’s Office deputies responded Thursday to the station at 1665 Branch Forbes Road after someone reported an unresponsive person near a gas pump. What they found when they got there checked off a deeply troubling list of circumstances no one expects at a mid-afternoon fuel stop.

Behind the wheel of the parked car was 26-year-old Patrick Voegtly, completely unconscious. Sitting in the backseat was his 5-year-old child. And in plain view inside the vehicle was a loaded gun. The situation only got more alarming from there once deputies started putting the pieces together.

When deputies managed to rouse Voegtly from his stupor and place him under arrest, they discovered a second firearm tucked in his pocket. His eyes were glassy, his speech was slurred, and a breathalyzer confirmed what his appearance already suggested: his blood alcohol content clocked in at more than double Florida’s legal limit of 0.08. At that point, the picture was about as grim as it gets.

Bodycam footage from the arrest captured a moment that stuck with a lot of people after the story broke. While deputies were assessing the scene, Voegtly’s child can be heard telling them not to worry, that his dad is “just sleeping.” It is the kind of thing that is hard to shake, a little kid doing his best to make sense of a situation no 5-year-old should ever be in.

What the Charges Against Voegtly Look Like

Voegtly was booked on three counts stemming from the incident. The first is Driving Under the Influence with a BAC over 0.15, which carries enhanced penalties under Florida law compared to a standard DUI charge. The 0.15 threshold is considered aggravated impairment, and the legal system treats it accordingly. The second charge is Child Neglect, which reflects the danger his child was placed in by being in the vehicle under those conditions. The third is Improper Exhibition of a Dangerous Weapon or Firearm, tied to the gun that was sitting in plain view when deputies arrived on scene.

Florida’s DUI laws already carry serious consequences for first-time offenders, but an aggravated DUI combined with child neglect and a weapons charge puts Voegtly in significantly more complicated legal territory. The combination of charges speaks to how many different ways this situation crossed a line.

What the Sheriff’s Office Had to Say

Hillsborough County Sheriff Chad Chronister did not hold back in his statement following the arrest. He called the decision reckless and pointed out that driving under the influence is dangerous on its own, but doing so with a child in the car while armed represents a complete disregard for the safety of everyone around. He credited his deputies with intervening before the situation turned into a tragedy, which, given the circumstances, was far from guaranteed.

Law enforcement agencies across the country have been increasingly vocal about the intersection of impaired driving and child endangerment, and for good reason. The National Highway Traffic Safety Administration consistently reports that drunk driving remains one of the most preventable causes of traffic deaths in the United States. Cases like this one are a reminder of why those conversations never really go away.

What We Can Learn From This Incident

Stories like this one tend to spark a lot of outrage online, and understandably so. But they also offer a window into some important conversations worth having. The most obvious is the continued danger of drunk driving, particularly when children are involved. Florida law already mandates that child passengers significantly increase DUI penalties, and many advocates argue those consequences still do not go far enough.

There is also the question of firearms and impairment. Having two guns in a vehicle while operating it in a blackout state creates a dangerous combination that goes beyond just the driver. First responders approaching a scene like that face their own set of risks before they even know the full picture.

Perhaps the most lingering part of this story, though, is that little voice on the bodycam footage calmly explaining that dad is “just sleeping.” Children in these situations rarely have the context to understand what is actually happening, which is exactly what makes the adults around them so responsible for the choices they make. Fortunately, in this case, someone at that gas station made the call that kept things from getting worse.
