Man Charged After Firing Five Rounds at Car Carrying 5 Children, Court Records Say

Monica Hicks was almost home Saturday night when the rear window of her car shattered.

Her five children, all younger than 10, were inside as someone fired repeatedly at the vehicle on Grant Road in northwest Harris County. Five-year-old Zah’Layah Walton was struck in the head. Two of her siblings were hurt by broken glass.

Hicks called 911, applied pressure to her daughter’s wound, and waited for paramedics, according to Harris County court records reported by the Houston Chronicle. Zah’Layah was flown to a hospital, where she died.

Less than a day later, Harris County Sheriff Ed Gonzalez announced that deputies had arrested 47-year-old Jeremy Porter on a capital murder charge. The explanation Porter later gave detectives, and the account Hicks gave reporters, leave one of the case’s central questions unresolved: what, if anything, happened between the two vehicles before the shooting began.

The sheriff’s initial arrest post identified the child as Zah’Layah Walter. Harris County’s medical examiner and court records later identified her surname as Walton, and later reporting corrected the name.

Court records say Hicks saw a white Ford pickup pass her at high speed after the rear window broke. Flock Safety cameras were then used to track the Ford to a home, where detectives located Porter.

Gonzalez said automated license plate reader information helped detectives develop critical information quickly. The arrest came within 24 hours of the shooting.

That technology did not answer the biggest remaining question by itself. Harris County District Attorney Sean Teare said Tuesday that the case was still in its early stages and that detectives were examining the circumstances that put the two vehicles beside each other on Grant Road. He also said Porter’s truck had not yet been fully processed and ballistics work was still pending, according to Houston Stringer’s report from the courthouse.

Five Shots

Court records say Porter acknowledged driving the Ford and firing five rounds toward Hicks’ vehicle. He told detectives he believed the other vehicle had fired at him and was being driven erratically. He also described the driver as a man.

Hicks has given a sharply different account. She told FOX 26 that she never exchanged words with the other driver, cut the truck off, or sounded her horn. She was driving her children home when the gunfire began.

Court records describe four apparent bullet strikes on Hicks’ vehicle. The sheriff’s office has described the case as an apparent roadway or road-rage shooting, while the motive remains under examination.

ABC13 reported that Porter was not brought into the courtroom for an early Tuesday setting and that the judge left the bond decision to the district court.

Later Tuesday, a judge found probable cause and Porter remained held without bond. Prosecutors said they intend to ask that he continue to be detained without bond while the case is pending, with another detention hearing expected in about 10 days.

The Harris County District Clerk’s public docket lists Porter in the 338th District Court on a capital murder charge involving a child. The charge is an accusation, and Porter is presumed innocent unless proven guilty in court.
